Marbury v. Madison | William Marbury and others were appointed to Congress; appointments were never delivered by James Madison. Madison won. The Supreme Court didn't have to issue the appointments regardless of entitlement. Establishes judicial review. |
McCullough v. Maryland | Congress established the Second Bank of the US. Maryland taxed the bank and they wouldn't pay. McCullough won. Congress could establish the bank and Maryland couldn't just tax them. Congress has unenumerated powers not outlined in the Constitution. |
Gibbons v. Ogden | Gibbons challenged him needing a special permit to navigate certain waters. Supreme Court decided that Gibbons was right, that power could only be exercised by Congress. |
Barron v. Baltimore | Barron sued the state because the accumulating sand was preventing business. Barron lost because the Fifth Ammendment is specifically made to limit the powers of NATIONAL GOVERNMENT. |
Dred Scott v. Standford | Scott sued for his freedom when he ran away to a free state. Ruled against Scott, saying that no descendent of slaves could ever be a citizen and therefore use the US courts. |
