Plaintiff An individual or a group of people who bring a complaint against another party in a civil case
defendant The party who answers a complaint and defends against it in a court case
Prosecution A government body that brings a charge against a defendant who is accused of breaking one of its laws
Precedent A guideline for how similar cases should be decided in the future
original jurisdiction A court’s authority to hear a case first
appeal To ask a higher court to review a decision and determine whether justice was done
appellate jurisdiction A court’s authority to hear an appeal of a decision by another court
courts of appeals Courts that handle appeals from lower federal district courts
circuit courts Another name for the courts of appeals
judicial review The Supreme Court’s power to overturn any law that it decides is in conflict with the Constitution
opinion A written statement by a court explaining the reasons for a decision
judicial activism An effort by judges to take an active role in policymaking by overturning laws relatively often
judicial restraint An effort by judges to avoid overturning laws and to leave policymaking up to the other two branches of government
What do federal courts do? Resolve legal conflicts, apply laws to actual situations.
What kind of conflicts do federal courts resolve? Criminal cases and CIvil cases/
What is a civil case? An issues about a disagreement.
True or false. Federal courts and The Supreme Court will only hear Civil cases. Fasle they will hear civil and criminal cases.
What kind of courts do courts do states have. Municipal courts that operate on a city level and take care of things like parking tickets. Most legal descions are decided upon by state courts.
What are circuit courts? Circuit courts are that take care of appeals from federal district courts.
Do courts of appeals function like normal courts? No, they just decide whether or not the previous court's descion was correct.
How many district courts are there in the US? 94

Was judicial review a part of the constitution? No, The supreme court gave itself this power very early on.
What case gave the supreme court the power to judicial review? and what what happened in that case? Marbury v. Madison. In this case Marbury was suing madison because he was not given the job promised to him by the president of the time.
What was the judiciary act? The judiciary act created the courts of appeals and the district courts.
What was the "Warren Court" (named after chief justice earl warren.) This was what the "personality" of the supreme court was called from 1953 to 1969.
What was the warren court well know for? an what was a well know case that occurred in that time? The warren court was well know for defending the rights of people of accused of crimes. A landmark case was Miranda v. Arizona.
True or false. The Warren court was well know for being a good example of judicial restraint. False. The Burger Court was well know for showing judicial restraint. The warren court was well know fro their judicial activism.
Was judicial review in the constitution. No, judicial review was established with the Judiciary act.
How are judges selected? No requirements, chosen by the president, adn approved by the senate.
What is the supreme court? The highest court in the land.
How does the supreme court decide which cases to hear? They hear cases about constitutional issues.
What does judicial review give the courts the power to do? They may overturn laws.
What are both sides of the court cases called? Parties.
Which courts have the highest workloads? DIstrict courts.
Who decides the facts in a case? The Jury
In the case Miranda v. Arizona who is the defendant? Arizona
What document set up the frame work for the judicial branch? The constitution.
What is a circuit? The area a court covers.
What is the #1 priority of the supreme court? To be the final court of appeals.
What are the two types of courts at the federal level? Supreme and Federal
Does the supreme court get absolutely no help when deciding? They get help from the President.
