What are the two main laws in relation to the consumer? | The two main laws are consumer protection act 2007 ant the sale of goods and supply of services act 1980 |
What does the sale of goods and supply of services act 1980 set out? | It sets out the rights of consumers ,the responsibilities of retailers and the remedies of redress |
What is merchantable quality? | It is part of the sale of goods and supply of servies act 1980. It states that goods must be of metrchantable quality |
What is meant by services in the sale of goods and supply of services act 1980? | Services are provided with 1)care and dilligence 2)Service provider must have have proper skills to do the job 3)also any materials supplied must be of high quality |
What is inertia selling? | Inertia selling is when goods are sent to people who have not ordered them and a bill is requested to pay for them |
What is redress? | Redress is when people are entitled to there rights if a good or service is faulty there are three forms of redress 1) Repair 2)Refund And 3) Replacement |
Name 3 sellers responsibilities? | The seller respnsibilities are 1) The seller must ensure that consumers get there statutory rights. 2)Signs or statements which deny responsibilities are illegal. 3) Guarantees which offer additional rights. |
What is the national consumer agency? | It was set up in 2006. This act was intended for 2007 to give the act power. it powers to 1} investigate unfair trading practices 2} Issue on the spot fines also to prosecute offenders and publish names.3} to ban or recall unsafe products |
What are non-legislative resolutions? | You could complain to the retailer it is much quicker. Firstly you go back to the retailer and bring a receipt. Secondly you ask for the manager an complain politely. Thirdly you know your rights under the law and insist on them. |
How do you seek help from third parties? | Firstly the director of consumer affairs provides frees helpful information and advice. Secondly trade associations may resolve disputes between businesses. Thirdly the Irish motor industry will examine complaints in garages. |
What is the Irish Travel Agents Association? | It examines complaints about members in that group. |
How does the consumers association of Ireland resolve problems? | It provides consumers advice through leaflets and in a monthly magazine called "consumer choice" |
What is a ombudsman? | A ombudsman is someone who helps a person solve complaints. There are three types: 1)Banks 2) Insurance companies 3)And public sectors. Before going to the ombudsman the consumer must solve the problem before asking a ombudsman. |
Give examples of non-legislative methods? | The media is a way to bring attention nationwide on radio, television or online.E.G ring Joe Duffy. Secondly You could go to the consumer association of ireland which provides informal or inexpensive methods of solving conflict E.G Eddie Hobbs |
What are legislative methods to resolve complaints? | 1) The Small Claims Court is a cheap quick method you can get £2000 of compensation and it is £15 of a fee. Also the court has to hear both sides of case. Also you may have to employ a solicitor and take retailer to court |
What is Caveat Emptor? | "iT LETS THE BUYER BE AWARE" of rights and have legal action against retailer. |
