Battery in a Detention Facility

QuestionAnswer
Whenever a person who is detained in prison, jail, or other det. fac. is charged w/ committing an assault or agg assault or a batt or agg batt upon any visitor to the det fac or upon any other detainee in the det fac. Battery in a Detention Facility
Whenever a person actually and intentionally touches or strikes a Law Enforcement Officer. Battery on a Law Enforcement Officer
Upon notification of a Battery on Law Enforcement Officer, the reporting officer will: 1. Complete and attach a COPSMORE Informational Report to the electronic Arrest and Booking report so it can be reviewed at First Appearance; and 2. Follow up with State Attorney’s Office.
In making the charging decision, take into consideration the inmate’s: 1. Intoxication due to alcohol or drugs; 2. Mental Illness; and/or 3. Ability to form intent.
Upon discovery of an Inmate on Inmate Battery, the officer will: 1. Call for asst if need; 2. Notify the area supv; 3. Rem & sep vic(s) and agg(s) in accordance with training; & 4. Isolate the area & preserve the scene as well as any related evd until the responding p.o. clears the area for use, (if applicable).
The area supervisor will: 1. Respond 2. Notify(DHS)staff 3. Notify Watch Lt 4. Designate a co to call rescue 5. Assign co to rec sig events 6. Prohibit from affected area 7. Isolate sus/wit. 8. Determine if discip. actions will be pursued.
The Watch Lieutenant will: 1. Determine if criminal charges will be pursued. 2. ensure i/n in-cell prop & personal prop is stored in the prop rm & secured for subsequent investigations. & 3. Notify the JSO's comm center & request the response of a p.o.
The Watch Lieutenant will:Determine whether criminal charges will be pursued. When considering whether to pursue criminal charges, the following issues will be taken into consideration: a. # assailants b. # victims c. Seriousness. demons act of vio d. Who the agg(s) e. Who started incid f. If vic wants to press char g. If ofcs obs inci h. If sus adm striking vic i. If inci was gang-rel j. I/m charges & k. Prob of prosec.
In the event an inmate (victim or suspect) is transported to the hospital, the Lt will: ensure his in-cell property and personal property is stored in the property room and secured for subsequent investigations. If the property is part of a crime scene, it will be preserved as evidence
A Copsmore Informational Report will be completed and submitted by the reporting staff member.
All staff members as well as any inmates who may have knowledge of the incident will obtain: Witness statements
