Consumer Conflict

Legislative | Using the LAW to solve conflict or going to an office or organisation that was set up as a consequence of a law |
Negotiation | This involves parties explaining their position and bargaining to try to come up with a mutually acceptable solution. |
Consumer Association of Ireland | works to protect and promote the interests of consumers in Ireland. |
Ombudsman for Public Bodies | Investigates complaints by a member of the public who is dissatisfied with the service received from certain public bodies. |
Financial Services Ombudsman | Deals independently with unresolved complaints from consumers about their individual dealings with all financial service providers. |
Merchantable quality | This means that the goods should be of reasonable quality, taking into account what was said about them, what they are supposed to do, the price paid, how long they should last, etc… |
Fit for purpose | This might include the normal purpose that such goods are used for, or it could be some particular purpose made known to the seller at the time of purchase. |
As described | ...whether the description is on the package, something said by a salesperson, or written in a brochure. |
Conform to sample | When goods are bought after seeing a sample they should correspond with the sample. |
Quiet Possession | The seller has a right to sell the goods. The buyer can use them as they wish. |
The seller | ..is always responsible for their side of the contract, not the manufacturer. |
A guarantee | is a bonus in addition to the consumer’s normal legal rights and cannot affect or take away the normal legal rights against the retailer. |
Redress | is a remedy or a method of putting things right. |
Unsolicited Goods | Sending goods to someone who has not ordered them and then seeking payment. |
Pyramid Promotion Schemes | This is a business that does not actually sell products. It is a scam whereby some people deliberately set out to make money at the expenses of others. |
National Consumer Agency | the state agency that Promotes consumers’ awareness of their legal rights and Ensures that consumer legislation is obeyed by businesses. It was set up by the Irish Government under the Consumer Protection Act, 2007. |
Small Claims Court | Provides an inexpensive, fast and easy way for consumers to resolve disputes without the need to employ a solicitor. |
