TermDefinition
tort A civil wrong not arising from a breach of contract; a breach of a legal duty that proximately causes harm or injury to another.
negligence The failure to exercise the standard of care that a reasonable person would exercise in similar circumstances.
damages Money sought as a remedy for a breach of contract or a tortious action.
intentional tort A wrongful act knowingly committed.
assault Any word or action intended to make another person fearful of immediate physical harm; a reasonably believable threat.
battery The unexcused, harmful, or offensive, intentional touching of another.
False Imprisonment depriving a person of freedom of movement without consent and without privilege
Defamation a false statement that injures another's reputation
Invasion of Privacy unwelcome and unlawful intrusion into one's private life
tresspass to land The entry onto, above, or below the surface of land owned by another without the owner's permission or legal authorization.
Conversion a tort that involves theft or destruction of another's property
Fraud the crime of intentionally misrepresenting an existing fact
strict liability responsible for injury regardless of negligence or intent
Injunction Court order for a person to do or not to do a particular act.
Evidence is presented to jury (anything a judge will allow -- documents, records, photos, weapons, charts, objects, etc.)
Testimony is given under oath by witnesses and expert witnesses
Witness Someone who has personal knowledge of the facts
Subpoena written order by judge commanding a witness to appear
Verdict The court's decision
Judgement The final result of a trail
