O que é revelia? é um ato-fato processual que ocorre quando o réu não apresenta contestação.
Quais são os efeitos MATERIAIS da revelia? é a presunção de veracidade das alegações de FATO (e não de direito) feitas pelo autor *os prazos contra o réu revel que não tenha advogado fluem a partir da publicação da decisão no órgão.
Quais os efeitos PROCESSUAIS da revelia? >preclusão em desfavor do réu de poder alegar algumas matérias, exceto as do art. 342. >possibilidade de julgamento antecipado do mérito, caso se produza o efeito material.
Quando a revelia não irá produzir os efeitos materiais? 1 - havendo pluralidade réus, um deles contestar a ação. 2 - litígio versar -> dtos indisponíveis 3 - PI não -> instrumento que a lei considere indispensável à prova do ato. 4 - alegações inveross. ou contra. as provas dos autos.
O revel pode intervir no processo? SIM, em qualquer fase, só que recebe no estado em que se encontrar. Nesse caso passará a ser intimado dos atos.
Réu revel pode produzir provas? SIM, desde que se faça representar nos autos a tempo de praticar os atos processuais.
A revelia acarreta a procedência automática dos pedidos? NÃO
No caso de revelia, o autor pode aditar ou alterar a causa de pedir? Não, salvo se promover nova citação do réu, a qual reabrirá o prazo de 15 dias para resposta.
Se o réu apresentar contestação, mas essa for intempestiva? Não poderá deixar de ser intimado, mas poderá o ocorrer o efeito material da revelia.
É possível ao réu revel ajuizar ação rescisória por erro de fato? SIM, se sentença considerar existente fato que não ocorreu ou inexistente fato que tenha ocorrido.
