Civil key terms

TermDefinition
Actual Harm The victim suffers an injury or gets their stuff messed with like destroyed, or gets some money stolen
Alternative Dispute Resolution When a party tries to solve the disagreement outside of the court
Arbitration Giving the power to settle the problems with an outside third party
Advantage Arbitration advantage results in a fair solution mainly because they get an unbiased objective viewpoint
Assault You strike someone or do battery to them, inflict injury upon another person
Assumption of Risk When the defense side raised when the plaintiff knew the risk but still took their chances of being injured
Battery Unlawful touching or forceful of another person using a variety methods. Bring injury onto them
Breach When you break what your duty was to another person
Causation When that breach of the duty results in injury
Comparative Negligence Defense that is raised when each party has carelessness and it is compared
Contributory Negligence When the defense has proof that the victim did something that would cause the injuries that happened
Conversion When the property is stolen, destroyed, or is really just used outside of what the owner wants
Court Injunctions A court order that prevents a party from doing an act, and it can be permanent
Damages Payment that is recovered in court by a person who got injured
Defamation A false statement that would hurt someone's rep or good name that they built up, similar to slander
Duty obligation to use a reasonable standard to prevent some injuries to others
False Imprisonment When you want to intentional put someone in confinement against the person's will or without the lawful ability to be able to do it
Fraud Happens when there is an intentional fudging of a very important fact that causes a victim to give up a fact or something of value
Interference with Contracts When a third party encourages a breach in a contact of any way, and the said third party can be liable for it
Invasion of Privacy Uninvited intrusion into somebodies person life
Mediation When parties want to have a mediator to help come to a solution
Money Damages When you steal or damage somebodies money in anyway
Negligence A tort that usually results when one person can be careless to another person, like a mom forgetting about a baby
Proximate Cause When it is reasonably seen that a breach of the duty will result in injury
Punitive Damages Damages that exceed a small amount and can be resolved with money, like more hard and damaging damages
Tort A private wrong committed by one person against another person
Trespass to Land Entry onto somebody's land without their consent
Vicarious Liability When one person can tort another person
