Legal Glossary Content you need to know:
Term | Definition |

Summary offence | Less serious offence tried in a local court with a magistrate, the judgement and punishment is determined by a magistrate, the charges are laid by a police officer, the punishment will usually not be severe, such as , a fine or some community service |
Indictable offence | More serious offences tried by a judge and a jury, judgment is determined and the punishment is determined by a judge, the charges are laid by a public prosecutor, the punishment is usually a large fine or jail time |
Crime | A crime is a an act or an omission which can be punishable by the law, an offence which has been classified as a crime is classified as an 'indictable offence' |
Actus rea | The physical actions committed against someone |
Mens rea | the mental component so are they struggling from a mental illness or has anything |
Accused | A person on trial for a crime but is yet to be found guilty. |
Witness | A person who has seen or heard relevant information for a crime. |
Suspect | A person who is thought to have committed a crime and is being investigated. |
Warrant | an official document giving the police (or someone else) the power to: arrest you. search you, your vehicle, or your home. take and keep your things found in a search. put you in jail. |
Arrest | using legal authority to deprive a person of his or her freedom of movement. An arrest is generally made with an arrest warrant. An arrest may be made without a warrant if probable cause and exigent circumstances are presented at the time of the arrest. |
Charge | a formal accusation made against someone, often in criminal court. An example of charge is the legal proceeding when someone is formally accused of murder. |
Summons | The paper that tells a defendant that he or she is being sued and asserts the power of the court to hear and determine the case. A form of legal process that commands the defendant to appear before the court to answer the complaint made by the plantiff. |
Victim | A person who has suffered a loss (mentally, physically, financially) due to the act of another. |
