Chapter 4: The U.S. Constitution
Term | Definition |

Rule of Law | Principle that the law applies to everyone, even our leaders. |
Loose Construction | A way to interpret the Constitution by bending its meaning to fit modern times. |
Republican Government | The Constitution guarantees that the Federal government will ensure states have this (aka representative democracy). |
Due Process | Fair treatment in the court system, including things like your right to a lawyer, or your right to remain silent. |
Individual Rights | The basic freedoms given to citizens found in the Bill of Rights. |
Legislative Branch | Branch of government that make laws. |
Checks & Balances | Each branch of gov has powers that can limit the power of the other branches. |
Executive Branch | Branch of government that enforces laws. |
Independent Judiciary | A system of courts & judges that is free from other branches in order to fairly carry out their duties. |
Enumerated Powers | Powers that the federal gov has soley, such as the power to declare war, or the power to establish the Post Office. |
Strict Construction | A way to interpret the Constitution that tries to specifically follows what the document says. |
Federalism | Dividing power between the national government and state government. |
Implied Powers | Powers that are not necessarily clear, and their use can be open to interpretation. |
Judicial Review | Power of the Supreme Court that can declare acts of the other branches unconstitutional. |
Judicial Branch | Branch of government that interprets the law. |
Popular Sovereignty | Belief that political power comes from the people. |
Preamble | Part of the Constitution that explains its goals & purpose. |
Articles | Main body of the Constitution that explains how the government will work. |
Amendments | Including the Bill of Rights, they are the official changes to the Constitution. |
