What is a duty A obligation of law imposed on a person to perform or refrain from performing a certain act
Constitution Body of principles that establishes the structure of the government and the relationship of that government to the people what are governed
Who enacts statutory laws? Both Congress and state legislatures
What are criminal laws? Wrongs against society
What are civil laws? Laws that that define the rights of one person against another
What is jurisdiction? Power of a court to hear and determine a given class of cases, the power to act over a particular defendant
What are the three levels of the Federal Courts System? US Supreme Court, US Court of Appeals, and Federal District Courts
What is Writ of Certiorari? the US Supreme Court granting a right of review by a court of a lower court decision
What is the first step in a lawsuit? A complaint by the plaintiff against a defendant.
Name at the least two methods besides litigation that can be used to resolve a dispute? Arbitration, Mediation, Expert Panel, Association Tribunals, or Reference to a 3rd Person
What is a summary jury trial? Dry run or mock trial in which the lawyers present their claims before a jury or 6 people.
What is a minitrial? A trial held on portions of the case or certain issues in the case.
Is Rent-A-Judge a real thing? Yes. The parties hire a judge to hear the case through private courts to be a referee for the case.
True or False: Duties and Rights coexist. True
What is case law? Law that is expressed for the first time in court decisions.
What are administrative regulations? Rules promulgated by state and federal administrative agencies. Examples are the SEC or FDA, or EPA.
