What is the Establishment Clause? Prohibits the government from establishing an official religion, favoring one religion over another, & referring religion over non-religion
Which Amendment is the Establishment Clause under? First Amendment
What is the first amendment? Freedom of religion/speech/assemble
What is the Free exercise clause? Protects the rights of American citizens to practice any religious beliefs.
What is protected speech under the first amendment Hate speech, Racist speech, Flag burning, Symbolic speech
What is UNprotected speech under the first amendment? Fighting, words, threats, False information (libel, slander) Deception, fraud Obscenity (usually sexual) Child pornography
What does the first amendment ensures individuals can... Gather together to publicly support various causes/beliefs, movement, & protests
What can the government cannot do about the press? Censorship, restrict, review a story before publication
Prior Restraint: When the government restricts the press from publishing a story
What is freedom of the press? The idea that government censorship of the press is almost always unconstitutional
What is the second amendemt? The right to bear arms
What did the founding fathers believe about gun ownership? That citizens should own firearms for protection against tyranny-weapons of war
What is the third amendemt? Prevents government from forcing homeowners to allow soldiers to use their home
What was the Engel vs. Vitale case about? Public schools in New York began school days by inviting students to recite a nondenominational prayer each morning. The state decided that public schools cannot hold prayers every morning
What was the Wisconsin vs. Yonder case about? An Amish family were prosecuted under Wisconsin law for not sending their children to school. The state decided that the Amish family's religion could be respected
What was the Tinker vs. Des Monies case about? A group of high school students were suspended from school for wearing an armband in protest for the Vietnam war. Their rights were protected as long as it didn't disrupt the school environment
What was the New York Times vs. United States case about? The Nixion Administration attempted to prevent the New York Times from publishing materials obtaining classified information. The state believed that the press had the freedom to run the article
What does the government think about guns? We have the right to bear arms
