Easements Easements restrict a landowner's right to develop his land, and are enforced by the government. E.g - conservation easement, landowner retains private ownership of land, but may be forbidden from developing it in order to protect certain natural features
right of way A ROW is a right bestowed by a private landowner. It empowers an agency or individual to use the landowner's property to build or maintain a road, pathway, or utility line.
Permits Granted by a government agency, and empower the permit holder to carry out certain development activities. The permit application process can be shortened by imposing deadlines and carrying out the entire review process at a single location.
coming to the nuisance This applies when one property owner is engaged in a land use (i.e. farming) that another property owner sees as a nuisance. According to the courts, the person who has owned his property the longest has the higher land use priority and can continue
Land Evaluation and Site Assessment (LESA) 1981. LESA is a rating system by which local govs assess farmland and determine its suitability for future ag use. Created by the natural resources conservation service of the US Dept of Ag.
LESA (cont.) LESA examines several different factors including soil suitability, agricultural productivity, and the uses of neighboring parcels. It also examines outside factors with the power to influence land use, such as local geology, economy, and social pressure
