professionalism | an awareness & worthiness of the conduct & high standards of a given profession |
values | desirable qualities that determine our actions |
morals | deal with right & wrong |
ethics | our actions & decisions are based on the code of conduct advocated by a particular group |
autonomy | the right to act independently; the right to choose for yourself |
beneficence | acting in the best interest of the patient |
confidentiality | the right to privacy & an obligation to protect privacy |
justice | moral rightness or fairness (who gets what treatment when resources are scarce) |
nonmaleficence | doing no harm |
fidelity | faithfulness, loyalty; keeping your word |
veracity | truth-telling |
dignity | right to be treated with respect & appropriateness |
consequentialism | decisions are based on consequences/outcomes (greatest good for the greatest number) |
deontology | decisions are based on individual motives & morals, despite consequences |
Patient Bill of Rights | puts consumers back in charge of their healthcare |
EMTALA (Emergency Medical Treatment and Labor Act) | requires hospitals to treat ER patients regardless of ability to pay |
Under EMTALA, the ER MUST: | provide a medical screening exam & provide treatment to stabilize the condition |
HIPPA (Health Insurance Portability & Accountability Act) | gives patients control over their own health info & how it is used |
Under HIPPA, we should: | NEVER allow discussions to be overheard, NEVER share passwords, keep access to a NEED TO KNOW basis |
statutory law | law enacted by a federal, state or local government |
common law | law based on custom & usage (most malpractice suits are based on common law) |
criminal law | addresses wrongs against the state |
civil law | addresses wrongs to one party by another |
tort | actions leading to personal injury or property damage; negligence or intentional misconduct |
assault | threat to harm with the apparent ability to harm |
battery | touching without consent |
false imprisonment | unlawful confinement |
defamation | making a false statement that hurts another's reputation |
breach of confidentiality | failure to protect patient confidentiality |
lack of informed consent | failure to fully explain risks and benefits & to obtain consent |
negligence | unintentional injury caused by omission or commission of an act |
res ipsa loquitor | "the thing speaks for itself" |
discovery | facts sought by the plaintiff's attorney (study images, verbal questions asked under oath) |
trial | presentation of facts to judge or jury |
scope of practice | procedures for which the individual has received education & clinical experience & has demonstrated competency |
