How do you file a charge of misconduct? it's made in a letter to the Ethics Officer (may be anonymous) - identify certified planner, describe situation, cite provisions of Code
What happens when the Ethics Officer receives a charge of misconduct by a planner? communicate documentation to the respondent - 14 days - planner has right of counsel
What does a respondent include in a preliminary response to a charge of misconduct? timely, well documented counter argument - 30 days
Aspects of conducting an investigation? with or without preliminary response - Ethics Officer determines - conducted by Ethics Officer of designee - dismissal of charge or issuance of complaint
How long does someone making a charge of misconduct against a certified planner have to appeal a decision by the Ethics Officer to dismiss the charge? 30 days
How long does a planner charged with misconduct have to respond to a complaint from the Ethics Officer? 30 days
Aspects of conducting a hearing? if facts are in dispute - Ethics Committee appoints a Hearing Official - Ethics Officer has burden of proving by a preponderance of evidence
Who decides the case? Ethics Committee decides case and determines the appropriate sanction
What are the possible sanctions should a planner be found to have violated the Code? reprimand, suspension, or expulsion
What can take place during a settlement of the charges? allows for the withdrawal of the complaint
