Intro to Patient Care - Legal Terminology

Accountability being responsible for and accepting the consequences of the actions
Civil Law affects the legal rights of private persons and corporations. also know as private law
Criminal Law Relates to an offence against the general public caused by the potential harmful effect to society as a whole
Liability legal obligation a person has to make good for the loss of, or damage to, something for which he is responsible
Malpractice a form of negligence in which any professional misconduct, unreasonable lack of professional skill, or nonadherence to the sccepted standard of care causes injury to a patient
Negligence failure to do something that a reasonable person, guilded by normal considerations, would do, or doing something that a reasonable, prudent person would not do
Sandards of Care results or outcomes of care that patirnts can expect to recieve
Statute written laws enqcted by the legislature
Tort a wongful act or violation of a right, by act or omission, that can result in a civil action by the harmed person - a wrong or injury committed by one person against another
Constitutional formal set of rules and principles that descibe powers of a government and the right of the people
Statutory formal laws written and enacted by federal, state, or local legislatures
Administrative form of laws set by administrative agencies (includes State Board of Nursing)
Common court made laws. courts are responsible for interpreting written laws
