Medical/Legal and Ethical Issues
Term | Definition |

Scope of Practice | The skills and medical interventions the medical care provider is permitted to perform that are declared by legislation of the the state (what you should be able to do) |
Standard of Care | what you should do in a particular situation and how you should do it |
Expressed Consent | Adults who are physically and mentally able to give it. It must be informed consent |
Implied Consent | Physically or Mentally incapable of giving consent. |
Children & Mentally Incompetent Adults Consent | Parent or Guardian must give consent before care is given, unless in loco parentis (in place of parent) parents provided written documention to individual to act in their absence. ALSO implied consent |
Involuntary Transport | Potential harm to themselves or others, court ordered |
Refusing Consent Conditions | Of Age, awake and oriented, fully informed, sign release |
Negligence | EMT had a duty to act, breach of duty, Proximate causation |
