Abandonment | Stopping patient care with out the proper notification |
Act | A bill or measure that has become law |
Advocate | To intervene on the behalf of others |
Arbitration | A formal process that parties of a dispute agree to submit to a neutral party |
Assumption of risk | A defense to a lawsuit that establishes that the plaintiff assumed the risk of whatever caused the injury |
Autonomy | Ability to make independent decisions without constrain by others |
Civil law | Law that regulates relationships between individuals and groups |
Cloning | Producing genetically identical cells or individuals artificially |
Common law | Unwritten body of law based on general custom |
Comparative negligence | A defense to a lawsuit that establishes a percentage of responsibility for the injury on the part of the plaintiff |
Contingency | A condition that must be met before a contract is binding |
Contributory negligence | A defense to a lawsuit that establishes any responsibility for the injury on the part of the plaintiff |
Defendant | A person or group against an action that has been brought to court |
Deposition | Swearing to oath to an officer of the court before trial begins |
Do Not Resuscitate (DNR) order | An order signed by a physician not to revive the patient |
Drug Enforcement Administration (DEA) | The federal agency that enforces the Controlled Substance Act (CSA) 1970 |
Duty | Commitment to act in a certain way |
Emancipated minor | A person under age 18 has the rights as an adult including consent to medical care |
Fidelity | Faithfulness |
Fraud | Intentional deception resulting in injury or loss |
Gene therapy | Giving patients new genes or parts of genes to treat a disease or condition |
Genetic engineering | Making, altering, or repairing genetic material |
Health care proxy | A legal document that assigns an agent if someone is unable to make their medical needs known |
Informed consent | Agreement to a medical procedure after getting informed on it's pros and cons |
Licensure | When the state provides the license after viewing the qualifications |
Litigation | Process of taking lawsuits through courts |
Living will | A legal document with EXACTLY what the patient want and don't want for medical treatment |
Malfeasance | A crime or wrong doing that is illegal or contrary to official obligation |
Malpractice | Negligence by a professional |
Mature minor | Anyone under 18 with the maturity to provide consent for certain medical procedures |
Beneficence | Performing good deeds |
Bill | A law proposed by a legislative body |
Case law | Law established by decisions of previous court cases |
Misfeasance | Performing a legal act in an improper way |
Negligence | Failure to act as a reasonably prudent person |
Nonfeasance | Failing to perform an act that should have been done resulting in an injury |
Nonmalfeasance | Ethical concept requiring that an action do no harm or less harm than good |
Controlled substance | A drug that could be addictive or be abused |
Crime | An action that breaks the law |
Criminal law | Law that regulates offences against the public welfare |
Plaintiff | The person or group that makes the complaint in a lawsuit |
Prescription | An order to the pharmacist to dispense a supply of medication |
Privilege | A special immunity that protects against legal liability |
Prudent | Using care or common sense |
Embezzlement | Fraudulent of funds or property of employer or client |
Ethics | The branch of knowledge that deals with standards of behavior or beliefs |
Felony | A serious crime punishable by death or imprisonment |
Reciprocity | Automatic issuing of a license in one state to a holder of a license in another state |
Re ipsa loquitur | Things speak for itself (negligence) |
Respondeat superior | A legal document making an employer liable for the negligent acts of employees |
Right | A claim that is expected to be honored |
Larceny | Stealing another person's property or money without violence |
Liability | Legal responsibility |
License | Official permission to perform an activity or practice a profession |
Standard of care | Level of appropriate care required for a health professional |
Statute of limitations | A law limiting the time period for beginning a lawsuit |
Stem cells | Cells that have the capability to develop into various types of tissue |
Subpoena | A court order for a witness to appear and give testimony |
Mediation | Negotiation by third party to help 2 parties resolve a dispute |
Medical durable power of attorney | A written authorization to make health care decisions |
Misdemeanor | A less serious crime |
Statutory law | Law enacted by a legislative body |
Subpoena duces tecum | A court order to produce documents or records |
Tort | An injury or wrong against a person or property that does not involve breach of contract |
