"constitutional protections" refers to the basic protections granted by the Constitution: freedom of speech, press, assembly, religion, etc.
precedent example, model, pattern, standard, guide; refers to a court case with influences the similar court cases which come after it.
"due process" fair treatment when being accused of a crime or misdeed
enumerated listed, detailed, specified, cataloged
indiscriminate random, arbitrary, without just cause
disposition the nature or characteristics of (something)
chilling or "chilling effect" chilling: scary, terrifying, alarming ; "chilling effect": a phenomena where people are discouraged from exercising their rights because they are afraid of being unfairly punished.
legitimate real, valid, lawful, right, genuine
reframe to think about or express an idea in a new or different way; "think outside the box"
explicitly clearly, openly, specifically
affiliation connection, relationship, membership, link to, association with
impermissible not allowed, not permitted, forbidden
adversarial referring to fights, arguments; argumentative, combative, confrontational
